Implementation of Legislative Sustainability Requirements for Biofuels and Bio-Energy and Impact on Trade Markets

Abstract:

The growth of bio-energy currently goes together with the implementation of certain sustainability safeguards. Some sustainability criteria are actually integrated in legislation as a mandate, so all market actors dealing with biofuels and bio-energy for the specific market where the legislation is valid will be confronted with the practicle implementation of these requirements. We can monitor the implementation of these sustainability requirements in national systems, and how commercial actors are affected, which problems they may face. In this paper the obligated translation by the EU Member States of the European Renewable Energy Directive (2009/28/EC), which puts sustainability requirements to biofuels for transport and bioliquids (for stationary bio-energy) related to greenhouse gas savings ( 1 ), biomass from land with high biodiversity value (2), or from land with high carbon stock (3) and agro-environmental practices (4), are being discussed. The implementation experience of these first examples are given. Potential issues that may arise for market actors will be discussed. Distinction will be made between (1) biofuels for transport and bioliquids as this is very actual with the implementation of the RED and (2) biomass for stationary energy.
